Acceptance of Terms

By accessing the Kolsetu website (the "Website"), you ("User", "you", "your") agree to be bound by these Website Terms of Use (the "Agreement"). If you do not agree, you must cease using the Website immediately. Kolsetu reserves the right to amend these terms at its discretion. For material changes - those that affect your rights or obligations as a visitor - we will publish a notice on the Website at least 14 days before the change takes effect. Non-material changes such as editorial corrections take effect upon publication. Continued access after the effective date of any amendment constitutes acceptance of the revised terms.

1. About the Website

The Website provides information about Kolsetu and its AI voice automation solutions. The Website is the property of Kolsetu GmbH.

2. Intellectual Property

All pages of the Website and the Website itself are subject to laws and regulations relating to the protection of intellectual and industrial property. Visitors are permitted to view, electronically copy, download, or print Website content for personal, non-commercial reference purposes only, provided that no copyright, trademark, or other proprietary notices are edited or removed.

Content accessed through the Website is made available under a revocable licence granted by Kolsetu. Kolsetu retains full ownership of all content and all associated intellectual property rights. Any other use - including modification, adaptation, distribution, transmission, display, broadcasting, publication, licensing, reverse engineering, sale, or creation of derivative works - is expressly prohibited without prior written consent from Kolsetu.

3. Images and Media

Images, videos, and photographs on the Website are the property of Kolsetu or are used with permission of their respective owners. Use of these materials without prior written consent is prohibited and may constitute an infringement of copyright, image rights, personality rights, or other applicable laws.

4. Use of the Website

Kolsetu is not liable for losses arising from access to or use of the Website, including deterioration, disruption, alteration, or viruses that may affect your computer system or other property. While Kolsetu makes reasonable efforts to keep Website content current, it assumes no liability for errors or omissions.

5. Prohibited Conduct

The Website may not be used to publish or transmit offensive, unlawful, defamatory, obscene, discriminatory, or otherwise harmful material. Kolsetu reserves the right to take action where such conduct occurs, including removal of content or restriction of access. The following is also prohibited:

• Attempting to gain unauthorised access to Kolsetu systems or infrastructure

• Interfering with the operation or security of the Website

• Using automated tools to scrape or harvest data from the Website without consent

• Any use that infringes the rights of third parties

6. Elba Demo Interaction

The Website provides access to a live demo of Elba, Kolsetu's AI voice assistant. Use of the Elba demo is subject to an explicit consent notice presented before the call connects. By initiating a demo call, you confirm that you have read and agreed to that notice. The collection and processing of personal data in connection with the Elba demo - including voice recordings and transcripts - is governed by the Website Privacy Policy, available on www.kolsetu.com.

7. Indemnification

You agree to indemnify, defend, and hold harmless Kolsetu, its subsidiaries, officers, directors, employees, agents, licensors, and all persons involved in the creation, production, and distribution of the Website from all claims, liabilities, and expenses, including legal costs, arising from a breach of these Terms of Use or your access to or use of the Website.

8. Limitation of Liability

All information on the Website is provided 'as is' and without any warranty. To the maximum extent permitted by applicable law, Kolsetu and its suppliers expressly disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

Kolsetu and its suppliers are not liable for indirect, special, consequential, or incidental damages, including but not limited to lost profits, data loss, replacement costs, or other losses arising from use of the Website, even if Kolsetu has been advised of the possibility of such damages. This limitation does not apply in cases of intent or gross negligence, personal injury, or where mandatory statutory provisions provide otherwise.

9. Links to Third-party Websites

Kolsetu may provide links to independent third-party websites. These sites are not controlled by Kolsetu, and Kolsetu accepts no responsibility for their content, products, or services. Use of linked sites is subject to their own terms and conditions and privacy policies.

10. Privacy

Your use of this Website is governed by our Website Privacy Policy, available on www.kolsetu.com, which describes how we collect and process personal data of website visitors and Elba demo users. If you access the Elba platform as a contracted customer, the Product Privacy Policy and the Data Processing Agreement, both available on www.kolsetu.com, additionally apply.

11. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for any disputes arising from or in connection with these terms is Hamburg, Germany.

12. Website Access

Kolsetu reserves the right to amend, suspend, or discontinue access to the Website or any part thereof at its own discretion, including changes to or termination of content or availability, without prior notice.
